Morrow Brands Pty Ltd trading as Moso Morrow (Moso Morrow) recognises the importance of protecting the privacy of our customers and other third parties who provide their personal information to us (You).

What information do we collect?

There are two types of information that we obtain from you online and then store and use:

  • non-personal information that’s collected automatically from each visitor, such as your device operating system; and
  • personal information that you voluntarily provide to us or that is collected automatically.

Our policy for dealing with your personal information is explained below (Privacy Policy). By using our products and services, you agree to our Privacy Policy and consent to the collection, use and disclosure of your personal information as set out in our Privacy Policy.

Our Privacy Policy was last updated in October 2021 and includes disclosure of the matters set out in the Australian Privacy Principles.

When used in this policy, “personal information” has the meaning given to that term in the Privacy Act 1988 (Cth). Personal information generally includes any information that can be used to personally identify you.

By using our online and mobile resources or purchasing our products or services, you are signifying to us that you agree with this section of our privacy statement and that we may use and disclose your information as described.

Voluntarily Submitted Information

If you participate in certain activities via our online and mobile resources, you may be asked to provide us with information about yourself. We do not sell, rent, or trade voluntarily submitted personal information with third parties.  

If you don’t want us to collect this type of personal information, please don’t provide it. This means you shouldn’t participate in the activities on our online and mobile resources that request or require it and you may want to communicate with us by phone or regular mail instead. Participation is strictly your choice. Not participating may limit your ability to take full advantage of the online and mobile resources, but it will not affect your ability to access certain information available to the general public on the online and mobile resources.

Some of the ways you voluntarily give us your personal information and how we use it:

Emails and Online Forms – When you send us an email or fill out an online form, such as to contact us, your email address and any other personal information (e.g., home address or phone number) that may be in the content of your message or attached to it, are retained by us and used to respond back directly to you and to process your request. Depending on the personal information provided, communications from us may be in the form of emails, telephone calls, and/or text messages. We may also send you information about any of our products or services we think may be of interest to you.

Registering for an Account – When you register for an account, you submit personal information to us such as your name and email address which we then retain. We use that information to create and manage your account and in some cases establish a password and profile to communicate with you and any sub-accounts you created via email.  

Registering for Events – When you register for events, conferences or programs we ourselves may host (rather than outsource to a third party event manager with its own privacy policies), you will be submitting the types of identifiers described above. If the event requires a fee, we may also ask you to submit credit card or other financial information. We use this information to register you for the event and send you communications regarding the event.

Becoming a Customer or Subscriber to Our Service – We use any information provided from our customers to perform our contractual obligations and provide the products and services purchased to them, to manage their accounts and communicate with them.

Social Media and Community Features – Some of our online and mobile resources may offer social media-like community features letting users post messages and comments, and/or upload an image or other files and materials. If you choose to make use of these features, the information you post, including your screen name and any other personal information, will be in the public domain and not covered/protected by this statement.

Specific examples of the personal information we collect from you that is reasonably necessary for our business functions may include the following:

name;

residential or business address;

email address;

post code;

gender;

age and date of birth;

signature;

telephone number;

proof of identity, such as your drivers licence;

In addition to the information set out above, we may also collect other information from you – the sorts of information we collect will depend on your interactions with us. This information may not necessarily be personal information because it does not identify you personally however, this information is normally retained with your personal information and may include:

your shopping preferences and a list of products and services you have purchased from Moso Morrow. This may include your shopping history, product types, specifications, sizes, dimensions, colours, occasion date, or other attributes of products and services we have provided to you or may provide to you in the future;

account preferences, activity details and interactions (including statistics on page views and clicks), transaction details (such as payment method and where you shopped);

information we require to deliver, service or fulfil warranty obligations for products or services;

your marketing preferences, including the type of marketing materials you wish to receive and the method of delivery (email, SMS, direct mail, or other);

if you are a member of The Morrow Club, your membership number, and reward redemption history for special rewards, discounts or services;

information relating to your participation in, and interaction with, Moso Morrow membership programs;

other information you provide to us via our customer service centre, website, application forms, or directly to team members in relation to our products and services or delivering those products and services to you;

device identification information when you use a computer, mobile phone, smart phone, tablet, or other device to access our WIFI service or interact with us through our online store (www.mosomorrow.com). This information may include session cookies, your device IMEI number, IP address or MAC address; and

information collected via our secure payment processing systems.

Sensitive Information

Moso Morrow may collect sensitive information about you so we can recommend a particular product or service and/or otherwise provide their goods and services to you. Examples of sensitive information include information about your health, race and ethnic origin. We will not collect sensitive information about you unless we have your consent and the information is reasonably necessary for us delivering superior service to you (unless we are otherwise required or authorised by law to collect that information).

Purpose of collection of your personal information

We collect your personal information for purposes necessary to sell, promote and deliver our products and services to you. For example, we collect your personal information so that we can carry out the following actions:

to provide you with products and services that you have requested from us;

to communicate with you, including about products and services, competition results, special offers, and events which might interest you (including any associated Moso Morrow special offers and rewards);

to improve your experience with how we provide and market our products and services to you;

to answer your questions and provide you with information or advice;

to interact with you via social media and digital marketing;

to create orders, transaction records, agreements for the sale of products or services, accounts, tax invoices or receipts;

to provide your personal information to third parties that assist us in providing products and services you have requested, such as delivery service, customer service and fulfilment providers;

to carry out administration, marketing, planning, fraud and loss prevention activities, procurement, product and service development,

to carry out quality control and research (including via customer satisfaction surveys), analysis and tracking to improve the way Moso Morrow and its related bodies corporate and service providers provide products and services to you;

to consider and respond to complaints made by you;

to comply with laws or regulations or to comply with any directions given by regulators or authorities; or

if you are a candidate for employment or prospective contractor, to assess your suitability for a position at Moso Morrow or one of our related companies or brands. 

In addition, if you are employee at Moso Morrow, we may contact you after your employment ends to conduct an exit-survey.

We may also collect data about you on an aggregate and anonymous basis in order to help us improve the functionality of our website and tailor the way we communicate with you.

While you have the discretion to use a pseudonym or remain anonymous when dealing with us, the use of pseudonyms may prevent us from being able to provide you with products and services or for other purposes described in this Privacy Policy. This is particularly the case where you order goods which need to be delivered to your postal address, or goods subject to age restrictions such as the supply of alcohol.

Cookies, analytics and re-marketing

Cookies are small pieces of information captured when your device is used to access online content. We use cookies to ensure a more streamlined online shopping experience, to identify and store your personal preferences without the need for you to save them and provide you with appropriate and relevant promotions. We may use temporary (session) cookies or permanent cookies when you access our web site, which allows us to recognise your browser and track the web pages you have visited. We may collect this information in relation to your website account, as well as on an anonymous basis. You can switch off cookies by adjusting the settings on your web browser.

In addition, we use third parties including Google Analytics Advertising Features to promote our products and services. Google and other third parties collect data about traffic to this site via advertising cookies and identifiers, which are used display ads on other sites that are relevant to you, based on your previous visits to this site. Unsolicited information

We will endeavour to only take information from you which is reasonably necessary for our business functions. If you send us personal information that we have not requested, or we determine that the personal information you have provided to us is not reasonably necessary or directly related to any of our business functions or activities, we may de-identify or delete this information without notifying you to protect your privacy.

Normally we collect information from you directly, unless it is unreasonable or impracticable to do so.

How we hold your personal information

We may hold your personal information in either electronic or hard copy form. If you provide information to us electronically we retain this information in our computer systems and databases. This includes computer software programs, internet servers, and hosted internet solutions provided by third parties. If you provide information to us in hard copy (paper) this information is normally retained in our files and a copy is made to our electronic files.

Security

We use industry standard security measures to safeguard and protect your information. This includes taking reasonable steps to ensure your personal information is protected from misuse, loss, unauthorised access, modification or disclosure. 

Disclosure of your personal information

Your personal information may be disclosed in connection with any Purpose to any of the following:

our employees, contractors or service providers who provide services or functions on our behalf. This may include internet service providers, IT systems administrators, mailing houses, couriers, payment processors, and data entry service providers;

Affiliates

In addition to those third parties set forth above, we may share your information, including personal information, within our family of companies. Those companies will use such information in generally the same manner as we do under this privacy statement which includes sending you information about their products, services, or initiatives that may be of interest to you.  

Legally Compelled Disclosures

We may disclose your information, including personal information, to government authorities, and to other third parties when compelled to do so by such government authorities, or at our discretion or otherwise as required or permitted by law, including but not limited to responding to court orders and subpoenas. This may include the police service, ambulance service, or government departments or regulators within Australia in connection with law enforcement activities

To Prevent Harm

We may disclose your information, including personal information, when we have reason to believe that someone is causing injury to or interference with our rights or property, other users of the online and mobile resources, or anyone else that could be harmed by such activities.

Business Transfer

If we or any of our affiliates, or substantially all of its or their assets, are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation, or liquidation, personal information may be one of the transferred assets.

Vendors and Business Partners

We may share your information, including personal information, with our vendors and other third parties with whom we have a contractual relationship. We may also share your information, including personal information, with vendors who provide third party software services that you have chosen to assist you with your activities. We do our best to disclose only the information each of those parties need.

We have adopted standards for those vendors and business partners who receive personal information from us. We attempt to bind such vendors and business partners to those standards via written contracts. We further attempt to contractually restrict what our vendors and business partners can do with the personal information we provide to them such that it is used only to the extent necessary to carry out the business purpose for which it was provided; is not disclosed to anyone else without our consent or under our instruction; remains, as between us and the applicable vendor or business partner, our property; Please note, however, that we cannot guarantee that all of our vendors and business partners will agree to these contractual requirements; nor can we ensure that, even when they do agree, they will always fully comply.  

Overseas disclosure of personal information

We may disclose your personal information to third parties and service providers located overseas in connection with a Purpose. These include our services providers that are located overseas or hold and store data overseas including the United States of America and the Philippines.

Please note that some of our service providers who are located outside Australia may not be subject to Australian privacy laws or to privacy laws that offer equivalent protections and safeguards.

YOUR RIGHTS AND OPTIONS

You do not have to provide personal information to enjoy most of the features of our online and mobile resources. Moreover, you can opt out of certain activities like newsletters and announcements. 

We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.

Direct Marketing and Moso Morrow membership and subscription programs

We may send you direct marketing communications and information about products and services offered by us or our related brands, partners or suppliers via the channels you have nominated. This may include, but is not limited to, email, SMS, regular mail, social media and other digital channels. If you have indicated a preference for a method of communication, we will endeavour to use that method wherever practical to do so. By consenting to receive email marketing communications from Moso Morrow, you may also receive access to a range of exclusive offers and rewards not available to the general public. All the benefits from Moso Morrow membership and subscription programs will be delivered to you via email, including rewards and exclusive offers.

You may opt out of receiving marketing communications at any time by responding via the channel in which you received the marketing communication, or by contacting us (see contact information below). You can unsubscribe from emails by clicking the unsubscribe link on the footer of the email communication you have received. You may also update your personal information by editing your online profile. You may also receive marketing communications by post, email, SMS , direct and digital channels from our affiliated brands. If you do not wish to receive marketing communications from these organisations, you can let these organisations know by contacting those organisations directly. We do not provide your personal information to any other organisations for the purposes of direct marketing.

If your request is unlawful or may interfere with the privacy of others we may reasonably refuse to provide access to your personal information.

If you would like us to update or amend your personal information, please contact us and we will make the requested amendments.

We may ask you to verify your identity to ensure that personal information we hold is not improperly accessed.

Complaints and questions

If you feel your privacy has been breached, please contact us using the contact information above setting out the circumstances and reasons for your complaint.

Our team members will acknowledge receipt of your complaint promptly, and will normally respond to your request within 5 business days. If your complaint or query is complicated or requires further investigation our response may take additional time to finalise.
